1. Introduction

These Terms of Service ("Terms") govern your use of jfklovlien.com (the "Website"), all products and services sold through the Website, and all AI-powered tools embedded on the Website, including The Magus. The Website is operated by JFK Løvlien ("we", "us", or "our") through our US-registered LLC.

By accessing or using the Website, purchasing any product or service, or interacting with The Magus, you agree to be bound by these Terms. If you disagree with any part of these Terms, do not use the Website.

2. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes take effect immediately upon posting. Your continued use of the Website after changes are posted constitutes acceptance of the updated Terms. We recommend reviewing this page periodically.

3. Intellectual Property

The Website and its original content, features, functionality, branding, and design are owned by JFK Løvlien and are protected by international copyright, trademark, and other intellectual property laws. This includes all text, images, graphics, logos, book content, character names, series names, and AI system prompts.

You may not reproduce, distribute, modify, create derivative works from, or publicly display any content from the Website without prior written permission, except as expressly permitted by these Terms.

4. User Content

You retain ownership of any content you submit through the Website, including chat messages, uploaded files, and manuscript materials. By submitting content, you grant us a limited, non-exclusive license to process that content solely for the purpose of delivering the service you have purchased or requested. We do not claim ownership of your content and will not use it for any purpose beyond service delivery.

5. Products and Services

The Website sells physical books, digital products, design services, publishing setup services, AI-powered analysis tools, and author consulting. All prices are listed in USD unless otherwise stated. We reserve the right to change pricing at any time. Pricing changes do not affect orders already placed and paid for.

Physical products are subject to our Shipping Policy. Digital products and services are delivered electronically and are not eligible for return once delivery has commenced, except as described in Section 10.

6. The Magus — AI Assistant and Analysis Tools

The Magus is an AI-powered assistant embedded on jfklovlien.com. It is available in three tiers: Free, Pre-Launch, and Pro.

Accuracy and Limitations. The Magus is powered by artificial intelligence. While it is designed to provide helpful, knowledgeable, and relevant responses, it can make mistakes. AI-generated content — including publishing analysis, market intelligence, category recommendations, keyword suggestions, pricing guidance, social media strategy, advertising guidance, and manuscript feedback — is provided as informational guidance only and should not be treated as professional legal, financial, or business advice. Always verify important decisions independently.

No Guarantees. We do not guarantee that any analysis, recommendation, or strategy provided by The Magus will result in specific sales, rankings, visibility, or commercial outcomes. Publishing success depends on many factors beyond the scope of any tool or service.

Content Handling. Messages and files submitted to The Magus are processed in real time to generate responses. We do not permanently store conversation content or uploaded files beyond the active session. Manuscript text, screenshots, and other materials submitted through The Magus are not read, reviewed, or retained by JFK Løvlien personally.

Acceptable Use. You agree not to use The Magus to generate, request, or distribute illegal content, harmful content, hate speech, content that infringes third-party intellectual property, or content that violates any applicable law. Abuse of the system may result in access being revoked without refund.

Tier Access. Paid tier access (Pre-Launch and Pro) is tied to your Shopify customer account and cannot be transferred or shared. Pre-Launch access is valid for 14 days from purchase. Pro access is billed monthly and continues until cancelled.

7. Publishing Services Terms

The following terms apply to all publishing services purchased through the Website, including Amazon KDP Setup, BookVault Print-on-Demand Setup, Online Store Integration, Book Cover Design, and the Full Publishing Package.

Scope of Service. JFK Løvlien provides technical platform setup, configuration, and design services. JFK Løvlien does not act as a publisher, literary agent, or rights holder. The customer is the publisher of record for all books set up through these services.

Intellectual Property. The customer retains full ownership of all manuscripts, cover artwork, book descriptions, and associated creative materials. JFK Løvlien claims no intellectual property rights over any customer content. No rights are transferred in either direction through the purchase of any service.

Manuscript Handling. JFK Løvlien does not read, edit, alter, review, or retain manuscript content. Files provided by the customer are used exclusively for the purpose of technical upload and platform configuration. All customer files are deleted within 14 days of service completion unless the customer requests otherwise in writing.

ISBN and Publishing Identity. ISBN registration, ownership, and assignment are the sole responsibility of the customer. If a free ISBN is provided by a platform such as BookVault, the customer acknowledges that the platform's terms govern that ISBN. JFK Løvlien does not supply, register, or own ISBNs on behalf of customers.

Account Credentials. Any account credentials shared by the customer for the purpose of service delivery — including but not limited to Amazon KDP, BookVault, Shopify, WooCommerce, Wix, and PayHip — are used solely for the purchased service. Credentials are not stored or retained after service completion. The customer is responsible for changing passwords after service delivery if desired.

Book Cover Design. Upon final delivery and full payment, the customer owns the completed cover design files with full commercial rights and no licensing restrictions. JFK Løvlien retains the right to display completed cover designs in portfolio and promotional materials unless the customer requests otherwise in writing prior to project start. Two rounds of revisions are included in the standard price. Additional revision rounds may be quoted separately.

Delivery Timelines. Stated turnaround times begin when the customer has provided all required materials. Delays caused by incomplete materials, unresponsive communication, or third-party platform issues are not the responsibility of JFK Løvlien.

Customer Warranty. By purchasing any publishing service, the customer confirms that they hold all necessary rights to the manuscript, cover artwork, and associated materials they provide. The customer agrees to indemnify JFK Løvlien against any claims arising from content the customer provides that infringes third-party rights.

8. Author Consulting

One-on-one consulting sessions are purchased as individual bookings. Consulting content — including advice, strategy, and feedback — is provided for the customer's personal and professional use. Sessions are confidential. JFK Løvlien will not share session content with third parties.

Consulting advice is based on professional experience and knowledge but does not constitute legal, financial, or tax advice. Outcomes are not guaranteed.

9. Limitation of Liability

To the maximum extent permitted by applicable law, JFK Løvlien, including its directors, employees, partners, agents, suppliers, and affiliates, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from: your access to or use of or inability to access or use the Website or any service; any conduct or content of any third party on the Website; any content obtained from the Website or The Magus; unauthorized access, use, or alteration of your transmissions or content; sales performance or lack thereof resulting from any service, tool, or recommendation provided; third-party platform actions, policy changes, or account issues including Amazon, BookVault, Shopify, and others — whether based on warranty, contract, tort including negligence, or any other legal theory, whether or not we have been informed of the possibility of such damage.

10. Refund Policy

For publishing services and book cover design: if work has not yet begun, a full refund will be issued on request. Once platform setup or design work has commenced, refunds are not available. If JFK Løvlien is unable to complete the service for any reason, a full refund will be issued.

For Magus Pre-Launch access: refunds are available within 48 hours of purchase if no analysis session has been initiated. Once an analysis session has begun, refunds are not available.

For Magus Pro subscriptions: cancel at any time. No refunds for the current billing period. Access continues until the end of the paid period.

11. Privacy

Your use of the Website is also governed by our Privacy Policy, available at jfklovlien.com/policies/privacy-policy.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States. Any disputes arising from these Terms or your use of the Website shall be resolved in the courts of Delaware.
